Terms of Use for Recruit Jobs

These Terms of Use are intended to explain our obligations as a service provider and your obligations as a user.
Please read them carefully.

DataCamp, Inc. (together with our affiliates, “DataCamp”, “we”, or “us”) provides online recruiting and job application products and services, including certain premium services, through the DataCamp website located at https://www.datacamp.com/ (the “Recruit Service”). By registering for the Recruit Service you accept these Recruit Terms of Use (the “Recruit Terms”), which shall be in addition and supplemental to the agreement you have with DataCamp to access any other products and services provided by DataCamp (the “DataCamp Terms” and together with the Recruit Terms, the “Terms”). Additional terms may apply to specific features of the Recruit Service, and such terms will be presented when you engage with such features. To the extent of any conflict between the DataCamp Terms and the Recruit Terms with respect to use of the Recruit Service, the Recruit Terms shall control. The Recruit Service is made available for use only by (1) individuals searching for employment openings, or services or information related to their personal employment search or job search (“Job Seekers”) and (2) by individuals and organizations seeking information related to hiring or human resources, seeking Job Seekers, or seeking to make available information regarding employment openings (“Employers”). Capitalized terms not defined below will have the same meaning as set forth in the DataCamp Terms.


A. TERMS OF USE FOR EMPLOYERS

The following terms and conditions apply to all Job Seekers and other users who access or use the Recruit Service as intended for individuals seeking information regarding employment openings. For the purposes of this Section A of the Recruit Terms, all references to “you” or “your” shall mean the individual or, if the Employer is an organization, the individual accessing the Recruit Service on behalf of such organization, in your capacity as an Employer.

1. Account

In order to use the Recruit Service as an Employer you must have an Account. As an Employer, you may have the ability to allow Business Users to register for an Account to act on your behalf in certain respects (a “Role”), such as for recruiting or candidate outreach purposes. By granting a Business User a Role you represent that (i) you have the authority to provide such access; (ii) such Business User is authorized to act on your behalf; (iii) the Employer shall be financially responsible for the actions taken by the Business User, including, if applicable, the execution of binding contracts on your behalf of the Employer; and (iv) you are responsible for your Business Users’ compliance with the Terms and will be liable to DataCamp for any act or omission of such Business User. Employer and its Business Users are responsible for their use of the Recruit Service and any tools offered in connection therewith, including decisions regarding job description(s), the requirements for job(s), and whom to interview or hire. DataCamp assumes no responsibility and disclaims all liability for any actions an Employer or its Business Users take based on any information provided by DataCamp or through the Recruit Service.


2. Job Postings

Employers may create and make available job postings advertising employment opportunities and other job-related content, including links to third-party websites (“Job Postings”). Employer agrees that each Job Posting will be for one job opportunity only. In addition to any other restrictions in the Terms, Employer will not (nor permit any Business User to):

  1. Create a Job Posting without a reasonable and bona fide intent to hire for such employment opportunity.
  2. Create a Job Posting that is intended to mislead a Job Seeker.
  3. Create a Job Posting that is in violation of any applicable laws, including without limitation, laws related to data privacy, taxes, employment or discrimination.
  4. Use any automated means or form of scraping or data extraction to access, modify, download, query or otherwise collect information from the Recruit Service.

You are responsible for the contents of your Job Postings, emails, application form, screener questions or their format, criteria you set for inviting candidates to interview, and any messages that you send through the Recruit Service or otherwise, and agree that DataCamp is not responsible for such content and disclaims all liability for such content, including as to whether such content is legal. You agree that DataCamp may reject or remove any Job Posting or any questions for Job Seekers for any or no reason. You agree that it is your responsibility to refrain from posting any Job Posting that directly or indirectly discriminates against Job Seekers or otherwise violate applicable law. DataCamp reserves the right (but is under no obligation) to remove any Job Listing that directly or indirectly discriminates against Job Seekers or violates applicable law.


3. Job Application Handling

You agree that DataCamp may allow Job Seekers to apply for, or indicate an interest in, a Job Posting through the Recruit Service, that the information submitted by a Job Seeker will be presented to you as a job application and that DataCamp may send applications or other indications of interest to the email address you provide to us. You are solely responsible for reviewing job applications and other information. You agree that by using the Recruit Service, you are instructing DataCamp to assemble the candidate’s application materials, resume, answers to screening questions (if any), assessment responses and other information into one or more documents or files for distribution to you or to otherwise to make such information available to you through the Recruit Service. You further agree that DataCamp is not responsible for maintaining or storing such application materials, and that you are responsible for your own compliance with any applicable record retention requirements.


4. Communication through Recruit Services

You may receive messages, emails or other notifications about applications or your or a Job Seeker’s other activity on or use of the Recruit Service. In all cases, such messages or notifications are provided solely as a courtesy, and you should not rely on them. DataCamp does not guarantee, and disclaims all warranties and liabilities with regards to, the transmission or storage of such courtesy notices, nor does DataCamp guarantee their delivery, receipt or the date or time at which they may be sent.

DataCamp may use your email address to create an alias email address for your communications, in lieu of displaying your actual email address to the Job Seeker. Once a Job Seeker has your contact information, you agree that DataCamp is not responsible or liable for the manner in which the Job Seeker uses that information. If you send or receive communication on or through the Recruit Service, you agree to your communication being processed, analyzed, reviewed, and stored, including via automated means, for data analysis, quality control, enforcement of the Recruit Service’s rules and other DataCamp policies, content moderation, and to improve the Recruit Service or any other DataCamp product or service.


5. Confidentiality and Data Protection

Employer will keep confidential all information gained from or about a Job Seeker through the Recruit Service (including but not limited to name, identity or personal information of any Job Seeker), together with all other information relating to such Job Seeker which is of a private, proprietary or confidential nature (“Confidential Information”). Employer agrees: (1) not to disclose Confidential Information to any person other than its Business Users and other employees who have reasonable need to know the information in connection with the potential recruitment of the Job Seeker (and provided always that Employer ensures that such Business Users or employees are aware of the confidential nature of such information and agree to handle such information as confidential); and (2) to take appropriate physical, technical and administrative measures to protect the Confidential Information from loss, misuse, unauthorized access, disclosure or alteration.

In addition, you agree that for the purposes of applicable data protection legislation including but not limited to the Data Protection Act 2018 and the General Data Protection Regulation 2016/679 ("Data Protection Legislation") (as may be amended, modified or supplemented), the Employers is the data controller of any and all personal data that you collect from a Job Seeker through the Recruit Service and that you will process any such personal data collected from Job Seekers in accordance with the Data Protection Legislation.


6. Recruit Premium

Employer may upgrade to the DataCamp Recruit Premium service (“Recruit Premium”), which will provide you with the Recruit Premium services, including the ability to post jobs directly in the Recruit Service, access to additional candidate details, and candidate communication tools, among others. Access to Recruit Premium is expressly conditioned on timely payment of the then-applicable fee (the “Recruit Premium Fee”). We may include a separate charge for any applicable sales, use, value-added, or excise taxes, and any other similar taxes, duties or charges of any kind. We will remit taxes collected, if any, to the appropriate taxing authority. If payment is not received within the required time period, we may suspend your access to the Recruit Service until payment is received. Except as set forth in the Terms, all Recruit Subscription Fees are non-refundable.

Access to Recruit Premium is for an initial 12-month subscription term and Employer’s subscription will be automatically extended following any subscription term. Employer may terminate its subscription by giving written notice not less than 30 days before the end of the subscription term.

Given our confidence in the value of Recruit Premium, we guarantee Employer (as an entity and without regard to the number of licenses, seats, Business Users or Roles) will be able to make at least one hire through the Recruit Service during its initial subscription term. If Employer has not done so at the end of its initial subscription term, DataCamp will at its discretion, either (1) refund an agreed upon amount to Employer or (2) extend the term of Employer’s subscription by an agreed upon period (the “Guarantee”). In order to benefit from the Guarantee, Employer must (i) ensure all data related jobs are posted on or through the Recruit Service (excluding those that are not suitable for the Recruit Service), (ii) when technically possible integrate your applicant tracking platform with the Recruit Service; and (iii) continue to engage with DataCamp proactively throughout the term of your Recruit Premium subscription, including by responding to our messages promptly and implementing DataCamp’s reasonable suggestions. For the purpose of the Guarantee, “making a hire through the Recruit Service”, means that you identified the relevant candidate on the Recruit Service at any time in the six months prior to hiring the candidate, or we have evidence to suggest that the candidate found or applied to a role at your company through the Recruit Service. This may be demonstrated or evidenced through various actions, including but not limited to, shortlisting or messaging a candidate through the Recruit Service or hiring a candidate that saved or applied to a role from your company on the Recruit Service.

If you circumvent, or attempt to circumvent, the DataCamp Recruit platform in order to communicate with Job Seekers on the Recruit Service, then DataCamp may terminate your Account and ability to use the Recruit Service immediately and without notice to you. You agree that DataCamp will not be liable to you or any third party for any termination of your Account or access to the Recruit Service.

Any payment in respect of the Guarantee will be paid to Employer within four months after the end of the initial subscription term.


7. Indemnification

Employer shall indemnify, defend and hold harmless DataCamp, its agents, affiliates, and licensors from any third party claim or liability (including without limitation reasonable legal fees) arising out of or related to Employer’s or its Business Users’: (a) violation of the Terms; (b) use of, and access to, the Recruit Service; (c) loss of, or disclosure of, information gained from using the Recruit Service; (d) violation of any applicable laws or regulations, including but not limited to the Fair Credit Reporting Act, any applicable employment, equality, or discrimination laws, and any applicable data protection or privacy laws; (e) violation of any third party right, including without limitation any copyright, property, or privacy right; (f) claim that its or their content caused damage to a third party; (g) actions as an Employer, including without limitation doing or not doing the following: screening, hiring, promoting, or demoting any employee or Job Seeker; or (h) third-party service providers engaged by Employer to assist you with activities related to your use of DataCamp products and services, such as, but not limited to: facilitating your sourcing activities or track the conversion rates of Job Seekers. This defense and indemnification obligation will survive termination of the Terms and your use of the Recruit Service or any DataCamp product, program, or service.


B. TERMS OF USE FOR CANDIDATES

The following terms and conditions apply to all Employers and other users who access or use the Recruit Service as intended for individuals or organizations seeking to make available information regarding employment openings. For purposes of this Section B of the Recruit Terms, all references to “you” or “your” shall mean you, the individual accessing the Recruit Service in your capacity as a Job Seeker.

1. Job Postings

DataCamp may make available Job Postings, through DataCamp search results or otherwise through the Recruit Service. Job Postings are created and provided by third parties over whom DataCamp exercises no control. You acknowledge and understand that DataCamp has no control over the content of Job Postings, links to or from Job Postings, or any conditions third parties might impose once a Job Seeker has submitted an application or left the Site or the Recruit Service.

DataCamp has no obligation to screen any Job Posting, or to include any Job Postings, in its search results or other listings, and may exclude or remove any Job Postings from the Recruit Service or your search result without any obligation to provide reasoning for removal or exclusion. DataCamp cannot confirm the accuracy or completeness of any Job Posting or other information submitted by any Employer or other user, including the identity of such Employer or other user. DataCamp assumes no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of any Job Posting or other material or information available through the Recruit Service. While DataCamp may in some circumstances be compensated by Employers who post Job Postings, all Job Postings are considered advertising. DataCamp displays Job Postings based on a combination of compensation paid by Employers to DataCamp and relevance, such as search terms, and other information provided and activities conducted on DataCamp. You are not permitted to use DataCamp’s Recruit Service, Site or its content other than for non-commercial purposes.


2. Profiles and Resumes

By creating a profile on or through the Recruit Service or uploading a resume through the Recruit Service (“Your Resume” or “Job Seeker Resume”), you agree that DataCamp may associate Your Resume data with any other profile of yours on DataCamp (your “DataCamp Profile” and, together with Your Resume, your “Recruit Profile”). Your Recruit Profile consists of the information you provide in or through both your DataCamp Profile and Your Resume, including your full name, photo, links to third party social media sites, results of any DataCamp assessments or DataCamp certifications you may have completed, and any information in the "Job Preferences" section of your Recruit Profile, such as your desired job title, types of jobs, current location, desired locations, your availability or compensation. We may add compulsory or voluntary fields in the Recruit Profile from time to time.

By uploading Your Resume to the Recruit Service, you agree that DataCamp may convert it to a different file type. It is your responsibility to review your Recruit Profile to ensure that the content appears as you intend, and that it contains the right information or any information you intend to include or update. If you see any inaccuracy in your Recruit Profile, it is your responsibility to correct such information or to contact DataCamp to do so. Using Career Services does not guarantee a job placement at an Employer.

By creating your Recruit Profile, you are requesting and authorizing DataCamp to make your Recruit Profile available to third parties, such as Employers. DataCamp makes no guarantee that your Recruit Profile will be shown to any particular Employer.


3. Privacy and Settings

Information in your Recruit Profile, except as otherwise indicated through the Recruit Service, may be available to third parties, such as Employers. If you do not want DataCamp to make your Recruit Profile available to third parties or if you do not want Employers to contact you, set your Recruit Profile to private by indicating you are not open to a job or remove your Recruit Profile. You can update your settings under Settings in your Recruit Profile.

This change in your account settings will not affect your previous applications or prevent employers you responded to previously from contacting you. Applying to jobs or otherwise sharing your Recruit Profile with Employers may result in your Recruit Profile being copied and published even if it is set to indicate you are not open to a job. DataCamp assumes no responsibility and disclaims all liability for your Recruit Profile or application information that you share with Employers or otherwise make public.

To mitigate fraud, DataCamp may mask or hide certain portions of your information, for example, we may mask or hide your email address or phone number, from your Recruit Profile or application, and may substitute it with an alias. DataCamp makes no representations to you about whether all or part of your contact information will be masked or hidden, and the decision to mask or hide such info is in DataCamp’s sole discretion. DataCamp reserves the right to limit your ability to set your Recruit Profile to public, and may toggle a public profile to private, at any time, to prevent illegal conduct, for fraud mitigation, or for any other reason in DataCamp’s discretion.


5. Applying for Jobs on the Recruit Service

Your Recruit Profile and any application information that you submit through the Recruit Service, including personal data included in Your Resume, application or responses to screening questions is subject to the Terms. Prior to submitting an application, you acknowledge that you are responsible for reviewing and confirming that you are applying to your desired Employer. When you indicate your interest in a Job Posting by applying to or otherwise engaging with the Job Posting you are sending your resume and application information to DataCamp, and you are requesting and authorizing DataCamp to make available such application information in the form of one or more files or documents to the applicable Employer and agreeing to DataCamp’s processing of your application, as such processing is an essential part the Recruit Service. Once you provide information to an Employer (whether in the form of a job application, resume, email, or otherwise), DataCamp does not have control over the Employer’s use or disclosure of that information. If you want the Employer to delete, modify, or maintain confidence over any such information, you must contact the Employer directly. You also consent to your application and any responses sent to you by the Employer through DataCamp being processed and analyzed by DataCamp according to the Terms.

When you apply to a job through the Recruit Service, DataCamp will attempt to send your application to the contact information provided to us by the Employer, which may include sending your application to an applicant tracking system (ATS) or other service provider selected by the Employer. By applying for a job through the Recruit Service, you agree to an Employer’s use of such service providers, and acknowledge that such use may involve an intermediary’s access to job applications and other information sent to its Employer client. DataCamp does not guarantee that messages and applications will be delivered, received, accessed, read or acted upon. DataCamp also does not guarantee that any Employer will receive, be notified about, access, read, consider or respond to any such resume or other application material, make any determination with respect thereto or that there will be no mistakes in the transmission or storage of the data.

DataCamp has no responsibility for expired Job Posting or for delivery of applications prior to a Job Posting’s expiration. In addition we cannot vouch for the validity of the contact information provided to us by Employers. We also cannot vouch for the technical capabilities of any third-party sites, including but not limited to an Employer’s ATS. DataCamp is not responsible if an Employer’s ATS rejects or fails to deliver an application to an Employer for any reason.

When an Employer wants to contact you for a job, they will initiate a match request. You will have the opportunity to either accept or decline talking with them. If you accept their request to talk, you authorize DataCamp to make your contact information available to such Employer. If you do not want Employers to see your recruit profile anymore, or you don’t want Employers to contact you, indicate on your Recruit Profile that you are no longer open to a job as described above under Section 3. Privacy and Settings.

By using the Recruit Service, you agree that DataCamp is not responsible for the content of a job application, messages, screening questions or their format or method of delivery. DataCamp does not guarantee the validity of a job offer and cautions Job Seekers to verify the validity of a job offer before taking an adverse action regarding their current employment situations. Job Seekers are solely responsible for verifying the accuracy of any Employer or job offer.


6. Career Services

By uploading Your Resume, you are requesting and authorizing DataCamp, or a DataCamp vendor, to review or scan Your Resume and provide you feedback (in DataCamp’s discretion), including suggested changes. DataCamp assumes no responsibility and disclaims all liability for any changes you make based on any provided feedback.


7. Communications and other Recruit Service Activities

When you view, send, store or receive materials (including Job Postings, resumes, messages, applications, questions and responses in applications, and any other information) through or using the Recruit Service, DataCamp may, for example, use such materials for data analysis, quality control, or to refine the Recruit Service or any other DataCamp product or service (including to provide better search results and other listings for Job Seekers and Employers), whether via automated means or otherwise. When an Employer views, sends, stores or receives materials through or using the Recruit Service or takes any actions with regard to a Job Posting, Your Resume or your application, DataCamp may inform you about such actions. DataCamp does not guarantee your receipt of any such communications or of messages from an Employer. DataCamp may inform the Employer about activities you take on the Recruit Service, for example, whether you are online or active on DataCamp, and you hereby consent to DataCamp taking such actions and sharing such information.

DataCamp may use your email address to create an alias email address for your communication, in lieu of displaying your actual email address to the Employer. Once an Employer has your contact info, you agree that DataCamp will not be responsible or liable for the manner in which the Employer uses the info. If you send or receive communication on or through the Recruit Service, you agree to your communication being processed, analyzed, reviewed, and stored, including via automated means, for data analysis, quality control, enforcement of the Recruit Service’s rules and other DataCamp policies, content moderation, and to improve the Recruit Service or any other DataCamp product or service.


C. TERMS OF USE FOR ALL USERS

The following terms and conditions apply to all Job Seekers and Employers and other users who access or use the Recruit Service, or otherwise indicate their acceptance to these Terms. For purposes of this Section C of the Recruit Terms, all references to “you” or “your” shall mean you, the individual or organization accessing the Recruit Service in any capacity.

1. Use of the Recruit Services

You are solely responsible for your use of the Recruit Service, your Recruit Profile, any Job Postings and for any User Content you provide (including any profile information, file resumes or job postings), and for any consequences thereof, including the use of your User Content by other users. In addition, you acknowledge and agree that DataCamp is not a party to the relationship or any dealings between any users of the Recruit Service, including, without limitation any relationship or dealings between Job Seekers and Employers.

Without limiting the foregoing, you acknowledge that Users are solely responsible for (i) verifying and ensuring the accuracy, completeness and legality of any User Content (including Recruit Profiles and Job Postings); (ii) determining the suitability of any Job Seeker for any job or opportunity posted through the Recruit Service (including, by way of interviews, vetting, references, background checks and other similar actions); (iii) assessing the reputation, stability and outlook of any Employer, or the quality, benefits and drawbacks of any job posted by an Employer through the Recruit Service; (iv) negotiating and executing any applicable employments offers, letters or agreements between Users; or (v) for proper classification of Job Seekers as independent contractors or employees based on applicable legal guidelines.

DataCamp disclaims all warranties and liability with regards to the transmission or storage of such notices provided through the Recruit Service, does not guarantee their delivery or receipt, and does not guarantee the date or time at which they may be sent.

By using the Recruit Service, you acknowledge that when you view, send, store or receive information (including resumes, emails or notifications) through the Recruit Service, DataCamp may, for example, use such information for its internal business purposes including but not limited to data analysis, quality control, or to refine the Recruit Service or any other product or service (including to provide better search results and other listings for Job Seekers and Employers), whether via automated means or otherwise.


2. Accessing Third Party Sites and Services

The Recruit Service may contain links to other sites on the internet which are maintained by other third parties. You acknowledge and agree that DataCamp is not responsible for any content or services provided by these third-party sites, and DataCamp disclaims all liability from anything that may occur when you access such third-party sites or for the availability of, or the materials located on or through any such sites. You should review the terms of use, privacy policy and other applicable materials before using such sites. You should contact the site administrator for the applicable site if you have any concerns regarding such links or the materials located on such a site.


3. User Content

The Recruit Service may allow users to post content like Job Postings, resumes, information, text, images, audio, video, messages, and other materials (any such materials that a user submits, posts, displays, or otherwise makes available on or through the Recruit Service shall be included in the meaning of “User Content” as defined in the DataCamp Terms). Such functionality is designed to help users obtain career and company information, to let users know of jobs, to provide information about potential job candidates, and facilitate other communication.

You shall not post any User Content containing official identification information (whether your own or that of another person), such as social security number, passport number, national identification number, insurance number, driver’s license number, immigration number, or any other similar number, code, or identifier. Posting such identification information may lead to identity theft and other adverse consequences. DataCamp may remove any such identification information, but does not undertake any obligation to do so, and has no responsibility and disclaims all liability for any posting of such identification information.


4. Usage Restrictions

In addition to any usage restrictions in the DataCamp Terms, access to the Recruit Service is subject to the following fair use restrictions. You will not interfere with another user’s use and enjoyment of the Site. the Recruit Service or any other Service, including without limitation, through by:

  1. Generating or facilitating unsolicited commercial email(“spam”). Such activity includes, but is not limited to:

    • sending messages in violation of the CAN-SPAM Act under U.S. law or any other applicable anti-spam law;

    • imitating or impersonating another person or his, her or its email address, or creating false Accounts for the purpose of sending spam;

    • data mining the Recruit Service or any content, service, or property provided by DataCamp;

    • sending messages to Job Seekers who have asked not to be contacted;

    • selling, exchanging or distributing to a third party the contact information of any person without such person’s knowledge of, and continued consent to, such disclosure; and

    • using contacts made through the Recruit Service in violation of DataCamp policy, as determined by DataCamp, including, for example, as indicated by low response rates from those persons contacted.

  2. Sending, uploading, distributing or disseminating any unlawful, defamatory, harassing, abusive, fraudulent, infringing, obscene, or otherwise objectionable content, or offer to do the same. DataCamp may block the transmission of such content.

  3. Intentionally distributing viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other harmful code or items of a destructive or deceptive nature.

  4. Conducting or forwarding pyramid schemes or similar programs.

  5. Transmitting content that may be harmful to minors.

  6. Impersonating another person (via the use of an email address or otherwise) or otherwise misrepresenting yourself or the source of any email, message or other form communication.

  7. Transmitting another’s intellectual property or other proprietary or confidential information without such owner’s or licensor’s permission. Users who repeatedly post intellectual property owned by others may be banned from DataCamp.

  8. Violating the legal rights (such as rights of privacy and publicity) of others.

  9. Transmitting or storing any biometric information or biometric identifier.

  10. Promoting or encouraging illegal activity.

  11. Creating multiple user accounts in connection with any violation of the Terms or creating Accounts by automated means or under false or fraudulent pretenses.

  12. Selling, trading, reselling or otherwise exploiting for any unauthorized commercial purpose, or transfer, any DataCamp account.

  13. Contacting other DataCamp users about multi-level marketing (MLM) programs, jobs that require payment to start, or any topics DataCamp considers detrimental to its users.

  14. Create multiple Accounts not under your corporate or company name, in order to attempt to achieve higher visibility in the Recruit Service.

  15. Bypass any limitations or suspensions of functionality.

  16. Provide false information.

  17. Scrape the database related to any Service.


5. Disclaimer

THE RECRUIT SERVICE IS PROVIDED “AS IS,” WITH NO WARRANTIES WHATSOEVER, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF PROPRIETARY RIGHTS, TITLE, SERVICE QUALITY, AND THAT THE RECRUIT SERVICE AND SERVICES PROVIDED WILL BE UNINTERRUPTED OR ERROR FREE.
